The health basis for limiting mercury
The hazard that anchors dietary mercury regulation is methylmercury’s developmental neurotoxicity. It crosses the blood-brain barrier and the placenta and accumulates in developing neural tissue, so the fetus is exposed at the most sensitive stage of brain formation. The evidence base is two long birth-cohort studies — the Faroe Islands and Seychelles studies — and the major bodies read it into converging but not identical guidance: EFSA set a tolerable weekly intake for methylmercury of 1.3 µg/kg body weight in 2012, JECFA a provisional tolerable weekly intake of 1.6 µg/kg body weight in 2004, and the US EPA the most conservative value, a reference dose of 0.1 µg/kg body weight per day. ATSDR’s 2024 profile sets a chronic oral minimal risk level for methylmercury of 0.1 µg/kg/day.

Who the exposure reaches
The most vulnerable population is the fetus, and after birth the young child, because the critical endpoint is neurodevelopment during the prenatal and early-postnatal windows. That is why dietary advice on fish is targeted at pregnancy and early childhood, and why a certification limit on the fish categories that carry methylmercury protects exactly the eaters — expectant mothers and young children — whose exposure has the largest and most permanent consequences. The exposure is also unevenly distributed: communities that rely on frequent fish consumption can carry a far higher body burden than a national average implies.
Where mercury shows up in food

Why a certification limit is warranted
The concentration of the exposure in a few high-trophic species is what makes a certification limit effective: a limit does not have to touch most of the diet to remove most of the risk, because most of the methylmercury is in a small set of fish categories. Governments set maximum levels — the EU and Codex cap mercury in fish, with tighter figures for species destined for infant and child foods — but a maximum level is a ceiling, not a verified statement about a specific lot.
HMTc classifies methylmercury as one of four Tier-1 zero-tolerance toxics, speciates total mercury to methylmercury where a total figure could overstate the load, and sets its certification limit to the lower of the strictest existing government maximum level and the certified-market occurrence value, checked lot by lot.
